Missouri Supreme Court denies bid from attorney to prosecute the McCloskeys

The Missouri Supreme Court rejects an attorney’s request to try Mark and Patricia McCloskey, the St. Louis couple made famous after waving guns at protestors as they marched through their neighborhood.  St. Louis Circuit Attorney Kim Gardner had asked to be reinstated as the prosecutor in the case.  She had been removed after being accused of using her role as the prosecutor for political gain. 

This clears the way for former Cole County Judge Richard Callahan to continue as the special prosecutor in the case.

The McCloskeys have pleaded not guilty to charges of unlawful use of a weapon and evidence tampering.
